Terms of Service
By using Pushpad you agree to the following terms.
You must be at least 16 years old to create an account on Pushpad.
Content and acceptable use
Pushpad is not liable for the content delivered through push notifications, since it doesn't perform any preventive check.
The sender is accountable for the usage of the service and for the content of push notifications, which must be legal and respect the general rules described by the AWS Acceptable Use Policy.
Pricing is based on the max number of subscribers associated to your account during the billing period.
Any subscription associated to one of your project is counted, regardless of any other condition. For example, although we follow the best practices and we try to remove the expired or invalid subscriptions automatically, the total number of subscriptions may still include some invalid subscriptions, multiple subscriptions of the same user, browser or device, duplicated subscriptions across different projects or inactive subscriptions that you don't use.
Billing for legacy plans
Pricing for legacy plans is based on the number of notifications sent.
Notifications are charged regardless of their delivery status. For example if a subscription is invalid, but Pushpad tries to send a notification to it, that notification will be charged.
A notification sent to N devices is counted as N notifications. The number of devices (i.e. endpoints) is counted and charged when the request is made. For technical reasons, the number of devices that will be actually reached might be slightly different.
Data management and ownership
Pushpad is offered as is without any warranty.
Even if we do our best to follow best practices and offer a reliable service, Pushpad - to the extent permitted by law - is not liable for data loss, lost or wrong notifications or performance drops.
The limited accountability does not exclude the specific remedies described by the next section.
Service Level Agreement
Exluding scheduled maintenance windows, Pushpad will use commercially reasonable efforts to maintain 99.9% availability of the service for each calendar month.
The service is considered available as long as the customers can send some notifications.
In case the service level does not meet the above expectations, you can contact our support in order to get a compensation.
The compensation or any claim must be requested within the next calendar month.
The compensation will be issued in the form of promotional credits and it is not possible to ask for a refund.
The compensation is a percentage of the last invoice, equal to the percentage of downtime of the month.
The compensation cannot be issued if its value is lower than €5.00.
The compensation is excluded if the service level cannot be met for reasons of force majeure.
We make regular backups. However you are responsible for creating backups of your own data. You can export your data using the dashboard or the API: for example you should export all your subscriptions and the key pairs used for web push (you can find them in the sender settings).
Choice of law and venue
Any claim shall be construed in accordance with the Italian law.
You agree that any dispute arising from or relating to the subject matter of these Terms of Service shall be governed by the exclusive jurisdiction and venue of the Italian courts.
An account can be terminated by Pushpad for any reason.
Accounts and projects, without billing, that remain inactive for a long time may be removed by Pushpad.
You can close your account from your account settings after sign in. Any request to terminate your account sent by email or using other means will be ignored for security reasons.
Before deleting your account, for additional security, you need to delete all your projects and then wait a few days, during which the projects can be restored and the billing remains active.
